KINXHIP TERMS AND CONDITIONS

1. The Applicant represents that all information provided by him/her in connection with his/her Application is accurate (“Applicant Information”). In the event of any changes to the Applicant Information, the Applicant undertakes to inform KINXHIP of such changes within seven (14) calendar days of such change.
2. The applicant of KINXHIP Membership Card (“Applicant”) shall be at least eighteen (18) years of age.
3. The Applicant permits KINXHIP to disclose the Applicant Information to its holding company, subsidiaries, affiliates, associates, business partners, any related organizations and other membership programs administered by its affiliates or subsidiaries.
4. The Applicant acknowledges and agrees that his/her Application is subject to the approval of KINXHIP at its sole and absolute discretion. Upon KINXHIP approval of the Application, the Applicant will be deemed a member of the KINXHIP program (“Member”).
5. Membership to KINXHIP program is personal to the Member and shall not be transferable.
6. The Member shall be entitled to membership benefits and privileges. The membership benefits and privileges are personal to the Member and shall not be transferable to any third party. KINXHIP reserves the right to vary, amend, and modify the benefits and privileges at its sole and absolute discretion without prior written notice.
7. The Member shall be entitled to earn and accumulate KINXHIPoints which shall be implement before 2012. Points accumulation system shall be decided by KINXHIP at its sole discretion and may be amended from time to time.
8. The KINXHIP Points accumulated and earned by the Member shall be valid for thirty-six (12) months from the date earned (“Expiry Date”). Any unutilized KINXHIP points at the Expiry Date shall be forfeited without prior notice to the Member. No reinstatement requests thereto will be entertained.
9. The Member is required to personally present his/her KINXHIP Membership ID for all its program transactions including, without limitation, redemptions and discounts under its program.
10. The Member shall be responsible for the safe keeping of his/her KINXHIP Membership ID. In the event of the loss/theft of the Member’s KINXHIP Membership ID, he/she shall immediately notify KINXHIP’s Membership Marketing Department and/or subject to paragraph 13 below, request for a replacement KINXHIP Membership Card to be issued (“Replacement Request”).
11. KINXHIP reserves the right to:
  1. suspend the Member’s account in the event the Member lodges more than three (3) Replacement Request within any consecutive period of twelve (12) months;
  2. adjust the Member’s account status due to computer error, machine malfunction, operator error, fraud or other misuse of the membership card and/or at KINXHIP management’s discretion;
  3. transfer and/or deduct KINXHIP Points to settle any of the member’s outstanding account(s) that has been incurred within the program.
  4. cancel, amend or modify these Terms and Conditions (as may be revised by KINXHIP from time to time) at its sole and absolute discretion without prior notice to the Member; and
  5. terminate the Member’s account at KINXHIP’s sole discretion and in the event of such termination, all KINXHIP Points shall be forfeited.
12. These Terms and Conditions shall be governed by the laws of Malaysia.
13. The Applicant is deemed to have read, understood and agreed to be bound by these Terms and Conditions (as may be revised by KINXHIP from time to time) and such other terms and conditions which may be prescribed by KINXHIP from time to time in connection with the Application, the KINXHIP program and/or its Membership ID.
